These Terms and Conditions govern the use of the real estate crowdlending platform operated by Moaqnmfq Inversiones, C.A. (RIF: J-50319847-2), available at moaqnmfq.com. By accessing or using our platform, you agree to be bound by these terms in their entirety.
1. Definitions
For the purposes of these terms: "Platform" refers to the moaqnmfq.com website and all associated services. "User" is any natural or legal person who accesses the Platform. "Investor" is the User who participates in real estate crowdlending operations. "Project" refers to each real estate investment opportunity published on the Platform. "Developer" is the natural or legal person who requests financing through the Platform.
2. Registration Requirements
To use the Platform's investment services, you must be of legal age under Venezuelan law (18 years), possess a valid Venezuelan identity card or passport for foreign legal entities, complete the identity verification process (KYC) according to UNIF guidelines, and provide truthful and updated financial information. We reserve the right to reject or suspend registrations that do not meet these requirements.
3. Nature of Service
Moaqnmfq operates as a technological intermediary between Investors and real estate project Developers. We are not a financial institution and do not capture public deposits. Investments made through the Platform carry inherent risks, including the possible partial or total loss of invested capital. Past performance of previous projects does not guarantee future results.
4. User Obligations
By using the Platform, you commit to: providing truthful, complete, and updated information; maintaining the confidentiality of your access credentials; not using the Platform for illicit activities, including but not limited to money laundering or terrorism financing; carefully reviewing the documentation of each Project before investing; and immediately notifying any unauthorized use of your account.
5. Fees and Charges
Moaqnmfq charges an intermediation fee on the returns generated by investments, which is detailed in each individual Project. Applicable fees are presented transparently before confirming any investment. We reserve the right to modify our fees with a minimum notice of thirty (30) calendar days.
6. Investment Risks
Investments in real estate crowdlending are subject to risks including: default risk by the Developer, fluctuations in real estate asset values, risks associated with regulatory or legislative changes in Venezuela, liquidity risks given that investments have determined terms, and macroeconomic risks inherent to the Venezuelan environment. We recommend investing only capital you can afford to lose.
7. Intellectual Property
All content on the Platform, including texts, graphics, logos, icons, images, software, and its compilation, is the property of Moaqnmfq Inversiones, C.A. or its licensors and is protected by Venezuelan intellectual property laws and applicable international treaties. Unauthorized reproduction, distribution, or modification of any Platform content is prohibited.
8. Limitation of Liability
Moaqnmfq shall not be liable for indirect, incidental, or consequential damages arising from the use of the Platform. Our total liability for any claim shall not exceed the amount of fees effectively charged to the claiming User during the twelve (12) months prior to the event giving rise to the claim. We do not guarantee uninterrupted availability of the Platform or the complete absence of technical errors.
9. Dispute Resolution
Any dispute arising from these Terms shall be submitted, in the first instance, to a mediation procedure before the Arbitration Center of the Caracas Chamber of Commerce. If mediation is not successful within thirty (30) days, the dispute shall be resolved through arbitration in accordance with the Regulations of said Center, with its seat in Caracas, Venezuela.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Bolivarian Republic of Venezuela. Any provision of these Terms that is declared null or unenforceable shall not affect the validity of the remaining provisions.
11. Amendments
Moaqnmfq reserves the right to modify these Terms at any time. Modifications shall take effect fifteen (15) days after their publication on the Platform. Continued use of the Platform after said period constitutes acceptance of the modified terms. Registered users will be notified by email of substantial changes.
